Musk took the stand last week and told the jury AI "could also kill us all" while explaining why he wants $130 billion and OpenAI dragged back to nonprofit status. OpenAI's lawyer William Savitt cross-examined him for two days and they repeatedly bumped heads over Musk's evolving story.

😬 wait, did Musk just hand them a win?

Kinda, but not in the way you think. He admitted under oath that xAI used distillation on OpenAI's models to train Grok. He called it standard industry practice.

It's the first time a major US AI exec has confirmed on the record that American labs are training off each other's models. The exact thing OpenAI keeps accusing Chinese firms of doing.
